The Privacy and Data Protection Act 2014 (Vic) and the Health Records Act 2001 (Vic) guide how we collect, hold, use and disclose your personal and health information.
Collection of information
We can only collect health information if it’s necessary, and when it’s given:
- by consent
- as required by any law
- to prevent or reduce serious and imminent harm to any person
- any other reason as prescribed in the Health Privacy Principles of the Health Records Act 2001.

Disclosure of information
Your personal information and health information will not be shared with anyone unless:
- you tell us we can
- the disclosure is related to the purpose of collection and you would expect us to disclose the information
- the law requires us to disclose the information.
Some laws allow us to disclose your information in certain circumstances, such as:
- when your neighbour (or neighbour’s agent) requires your contact details for the purpose of contributing to the cost of a fence, which adjoins your properties
- contacting the ratepayer of a property for building protection works notices pursuant to the Building Act 1993
- contacting the owner(s) of a property to obtain approval for Council Report and Consent to construct on our adjoining property under Part 4 of the Building Regulations 2006.

Information Privacy Health Records Policy
The Information Privacy Health Records Policy relates to the use and management of personal and health information collected by Council.
We are committed to protecting the privacy of personal and health information collected and used by complying with our obligations under the Privacy and Data Protection Act 2014 (Vic) and the Health Records Act 2001 (Vic).

Brimbank City Council will collect information you provide to us when signing up to mailing lists.
We use Mailchimp to provides online tools to create, send and manage emails, which may collect personal and other information relating to those email addresses. We will only use this information to:
- Create, send and manage emails relating to the work of Brimbank City Council
- Measure email campaign performance.
Mailchimp may transfer this information to third parties where required to do so by law, or where such third parties process the information on Mailchimp's behalf.
Mailchimp is based outside of Australia and the information collected about your use of the website (including your IP address) will be transmitted to and stored by Mailchimp servers located around the world.
We are required to inform you that by subscribing to our mailing lists:
- You consent to your personal information being collected, used, disclosed and stored as set out in Mailchimp's Privacy Policy and agree to abide by Mailchimp's Terms of Use.
- You understand and acknowledge that this service utilises a Mailchimp platform, which is located outside of Australia.

Personal information may be collected by surveillance cameras operating in Council vehicles for the purpose of protection of Council’s assets from damage and will be used for this purpose.
The personal information will not be disclosed to any other person unless required by law or for insurance purposes.
You may apply for access and/or amendment to your personal information if required by contacting Council’s Senior Freedom of Information and Privacy Officer in writing.

Brimbank City Council uses Eventbrite Services which is a ticketing and registration platform that enables registration for events. Eventbrite may also use your information for its own purposes and you can view the Eventbrite Privacy Policy.
It is possible any information you provide to Council through Eventbrite may be held outside Victoria, please take this into account in your decision to book with us via this platform. If you choose to book with Eventbrite, you consent to the transfer and storage of the information provided outside of Victoria.
If you choose not to complete the booking, we may be unable to register you for the event. Please contact us if you would prefer to discuss an alternative way to register.

Zipform on behalf of Brimbank City Council is collecting your personal information to complete your registration for an eRates account.
If you choose to register for an eRates account, Zipform on behalf of Brimbank City Council will use your personal information for the sole purpose of fulfilling the provision of the eRates Notice Services. The eRates Notice Services are provided to a range of recipients including property owners, animal owners, corporate and financial customers, among others (“Recipients”).
The types of personal information we collect depends on the nature of our engagement with you. Examples of personal information we may collect include:
- General identification information such as names
- Contact details such as postal address, property address, email address, phone and mobile phone number
If you choose not to supply this information, Zipform may not be able to allow you to access or use of their products or services (or all of the features and functionality offered by Zipform) or to respond to queries or requests that you submit.
We will only use your information if we have a lawful reason to do so such as when it’s our legal duty, if we have your consent and when it’s in our legitimate interest to do so. The personal affairs information that you provide when registering for eRates (for example: name, address, email, phone number and unique identifier such as eRates reference number and assessment number), will only be used for the primary purpose that it was collected for, that being for the issue of Notices electronically, and, or via hard copy in the mail for the ratepayers / recipients, and not for any other secondary purpose without your explicit permission.
You agree to provide us with accurate, complete registration information. Your registration must be done using your real name and accurate information. Each registration is for your use only and on behalf of the stated entity. We do not permit (a) any other person using the registered sections under your name; or (b) access through a single name being made available to multiple users on a network. You are responsible for preventing such unauthorised use.
It is important that you make sure the personal information we hold about you is accurate, up to date and complete. If any of your details change or if you believe that any personal information we have collected about you is inaccurate, you will need to update your contact details via the eRates portal and also complete a change of details form via council’s website.
