Proposed Road Discontinuance
Public Notice Inviting Submissions Under Section 223
Brimbank City Council (‘Council’) acting under Clause 3 of Schedule 10 of the Local Government Act 1989 (‘Act’), proposes to discontinue the roads at Tunnecliffe Court and part of Ely Court, Keilor East as shown hatched on the plan below.
It is Council’s intention to transfer the portion of Tunnecliffe Court which is Crown Land to the Crown and to sell the remaining land from the roads by private treaty to the Greater Metropolitan Cemeteries Trust.
In accordance with section 223 of the Act, any person wishing to make a submission on the proposal must do so in writing no later than Tuesday 22 August 2017.

Any person making a submission is entitled to request in the submission that they wish to appear in person, or to be represented by a person specified in the submission, in support of the submission at a meeting of Council (or its committee established by Council for this purpose).
Council has determined that submitters requesting to be heard in support of his or her submission will be heard by a Hearing of Submissions Committee on 4 September 2017, at 6pm, at the Brimbank Community and Civic Centre, 301 Hampshire Road, Sunshine
All submissions will be considered in accordance with section 223 of the Act.
Following consideration of submissions, if any, Council may resolve to discontinue the roads, part of the roads, or not to discontinue the roads.
